01Who we are

monSpot is operated by Groupe Bien-aime.

You can reach us at info@email.monspot.ca.

These terms are for sellers who open an account. People who order from a seller have no account with us and have nothing to accept here.

02What monSpot does, and what it does not

monSpot gives you a public page, a catalogue, selling dates or appointments, and a view of your orders. Your customers order with no app and no account.

monSpot is not a payment service. We never touch your money, we hold no card numbers and we store no banking details. Your customers pay you directly, by whatever means you agree with them. A customer can say they have paid; only you can mark an order paid.

monSpot sells nothing on your behalf and is not a party to the contract between you and your customer. What you sell, its quality, its safety, the applicable taxes and the permits you need are yours.

03Your account

You must be 18 or older and give accurate information. You are responsible for what happens under your account and for anyone you give access to.

Your public address is myspot.ca/@yourname. We may refuse or reclaim a username that impersonates another person or brand.

04Your page and the marketplace

Your public page exists as soon as you open an account. The marketplace is optional: you appear in it only if you switch it on, and you can switch it off at any time in your settings.

While you are in it, we show what is already on your public page: your name, your story, your photos, your categories, your city and your prices. Never your street address.

05What you publish

Your words and your photos stay yours. You give us permission only to display them, resize them and serve them wherever your page is published, including the marketplace if you turned it on.

You confirm you have the right to use what you publish. We may remove content that is illegal, misleading or somebody else's, and suspend an account that repeats it.

06Your customers' information

When somebody orders from you, they give you their name, their phone number and sometimes their email or a delivery address. That information is yours: under the law you are responsible for it.

We host it on your behalf and only to run the service. We do not sell it, we do not use it for our own advertising, and we disclose it to nobody, unless the law requires it.

In return, you agree to use it only for your sales and your orders, to answer your customers' access and deletion requests, and to tell us without delay if you learn of a breach affecting your data.

07Payments and subscription

The subscription is billed at the price shown when you sign up. You can cancel at any time; the cancellation takes effect at the end of the period already paid, and amounts already paid are not prorated back, unless the law requires it.

Your customers' payments do not pass through us and carry no commission from us.

08What is not allowed

You may not use monSpot to:

• sell what the law forbids selling, or what you may not sell without a permit;
• pass yourself off as somebody else;
• send unsolicited messages to people who did not ask you for anything;
• collect information about people without their knowledge;
• reach another seller's data, or work around our protections.

09Availability and liability

We do what is needed to keep the service running, without being able to promise it will never be interrupted. Outages, maintenance and outside dependencies exist.

We are not responsible for sales you might have made, for the arrangements you reach with your customers, or for money they owe you. Nothing in these terms sets aside the rights the Consumer Protection Act gives you.

10Closing the account

You can close your account at any time by writing to info@email.monspot.ca. We may suspend an account that breaks these terms, with notice where that is possible.

On closure your public page stops being reachable and your data is deleted or anonymised on the schedule set out in the privacy policy.

11Changes

We may change these terms. If a change is significant we tell you in the service or by email at least 30 days ahead. Continuing to use monSpot after that date is acceptance.

12Governing law

These terms are governed by the laws applicable in Quebec. The courts of the judicial district of Montreal have jurisdiction, subject to any recourse the law opens to you elsewhere.

The French version governs. The English and Spanish versions are provided for convenience.
